Education Legal Support Fund

Over the past decade, ACSA has become increasingly involved in various constitutional and litigation matters regarding the implications of statutes and regulations on LEA programs and finances. As ACSA’s involvement in this arena has increased, so too has the challenge of securing monetary and staff resources to participate in lawsuits of statewide significance. In response, ACSA’s executive director created a legal support fund to provide dedicated resources for ACSA’s legal involvement.

School districts and county offices that are members of the CSBA Legal Alliance are eligible to join ACSA’s ELSF. More than 90 school districts and county offices are currently members of the ACSA ELSF. The fund is currently a plaintiff in the CSBA et al vs. SBE lawsuit challenging the State Board of Education’s authority to grant Aspire Charters School a statewide benefit charter. In addition, the fund is supporting a lawsuit challenging the state’s constitutional authority to defer K-12 mandate payments. The ELSF is advised by an advisory body chaired by the ACSA President under the direction of the ACSA Executive Board.
